By accessing, browsing, registering for an account, requesting a device valuation, scheduling a pickup, or otherwise using our platform, you acknowledge that you have read, understood, and agree to comply with these Terms & Conditions and all applicable laws.

If you do not agree with any provision of these Terms, you must immediately discontinue the use of the CashNow platform and its services.

2. Eligibility

To use CashNow's services, you must be legally capable of entering into a binding agreement under the laws applicable in your jurisdiction.

• You must provide accurate and complete information.
• You must own or have legal authority to sell any device listed on the platform.
• You must comply with all applicable laws and regulations while using CashNow.
• You must not impersonate another person or provide false identity information.

CashNow reserves the right to refuse or terminate services where we believe these eligibility requirements have not been met.

3. User Accounts

Certain features of CashNow require you to create an account or verify your identity using a mobile number, email address, or One-Time Password (OTP).

You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out using your account.

Your Responsibilities

• Keep your login credentials secure.
• Provide accurate and up-to-date account information.
• Notify CashNow immediately of any unauthorized account access.
• Avoid sharing your OTP or verification codes with anyone.

4. Services Provided

CashNow provides an online platform that enables users to obtain estimated values for eligible electronic devices, schedule inspections or pickups, sell devices through our authorized representatives, and access related services.

Our services may include:

• Online device price estimation.
• Doorstep device inspection and pickup.
• Instant or scheduled payment after successful verification.
• Order tracking and customer support.
• Partner and agent assisted services.

CashNow reserves the right to modify, suspend, or discontinue any service without prior notice where necessary.

The availability of certain services may vary depending on your location, device type, operational capacity, or other business and regulatory requirements.

5. Device Evaluation & Pricing

Prices displayed on CashNow are estimated values based on the information provided by the user during the quotation process.

Final pricing is determined only after physical inspection of the device by an authorized CashNow representative.

• Functional condition
• Original accessories
• Warranty status
• Market demand
• Verification of IMEI or Serial Number

6. Payments

Payments are processed only after successful inspection and acceptance of the device by both the customer and CashNow.

• UPI
• Bank Transfer
• Other approved digital payment methods

CashNow reserves the right to delay payments where fraud prevention, verification, technical issues, or legal compliance require additional review.

7. Legal Terms

By using CashNow, you agree to comply with all applicable laws, regulations, and governmental requirements.

• You confirm that you are legally authorized to sell the device.
• The device must not be stolen, counterfeit, blacklisted, or involved in any criminal investigation.
• You agree to provide truthful and accurate information at all times.
• CashNow reserves the right to reject any transaction that violates applicable laws or company policies.
• Any fraudulent activity may be reported to the appropriate law enforcement authorities.

CashNow reserves the right to verify ownership, identity, and the legal status of any device before completing a transaction. We may refuse, suspend, or cancel any transaction where sufficient verification cannot be completed or where legal concerns arise.

8. Prohibited Activities

While using CashNow, you agree not to engage in any activity that is unlawful, fraudulent, harmful, or that interferes with the operation of our platform or services.

• Provide false, misleading, or incomplete information.
• Sell stolen, counterfeit, fake, blacklisted, or illegally obtained devices.
• Attempt to manipulate device pricing or inspection results.
• Impersonate another individual or organization.
• Access another user's account without authorization.
• Attempt to hack, reverse engineer, scrape, or disrupt our platform.
• Upload viruses, malware, or harmful software.
• Violate any applicable laws or government regulations.
• Misuse OTP verification or payment systems.
• Interfere with CashNow employees, partners, or agents while providing services.

9. Intellectual Property Rights

Unless otherwise stated, all content available on the CashNow platform, including but not limited to our website, mobile application, software, source code, logos, trademarks, service marks, graphics, images, illustrations, icons, text, videos, audio, designs, layouts, databases, and other materials, are the exclusive property of Aruna F. Management LLP or its licensors and are protected by applicable intellectual property laws.

These materials are provided solely for your personal, non-commercial use while accessing CashNow's services.

You may not:

• Copy or reproduce any part of our platform.
• Modify or create derivative works.
• Sell, distribute, publish, or license our content.
• Reverse engineer or attempt to extract source code.
• Use CashNow trademarks or branding without written permission.
• Use automated tools to scrape or download platform content.

10. Disclaimer of Warranties

CashNow provides its website, mobile application, and related services on an "as is" and "as available" basis. While we strive to maintain accurate, reliable, and uninterrupted services, we do not guarantee that the platform will always operate without errors, delays, interruptions, or technical issues.

To the fullest extent permitted by applicable law, CashNow disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted access.

Device valuations displayed on the CashNow platform are indicative estimates only and are subject to verification during physical inspection. Final pricing depends on physical inspection, verification, market conditions, and other applicable factors.

CashNow does not warrant that:

• The website or application will always be available.
• The platform will be completely free from bugs or technical issues.
• All information will always remain accurate or up to date.
• Estimated device prices will always match the final purchase price.
• Third-party services integrated with CashNow will operate without interruption.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Aruna F. Management LLP ("CashNow"), its directors, employees, partners, affiliates, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the CashNow platform or services.

This includes, but is not limited to:

• Loss of profits, revenue, or business opportunities.
• Loss or corruption of personal or business data.
• Service interruptions, downtime, or technical failures.
• Delays in payment caused by verification or banking processes.
• Errors in pricing estimates or valuation calculations.
• Unauthorized access to user accounts resulting from compromised credentials.
• Damages arising from third-party services integrated with CashNow.
• Loss resulting from incorrect information provided by users.

CashNow's total liability for any claim arising from the use of our services shall not exceed the amount, if any, paid by you to CashNow in connection with the specific transaction giving rise to such claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Aruna F. Management LLP ("CashNow"), its directors, officers, employees, partners, affiliates, agents, licensors, contractors, and service providers from and against any claims, actions, liabilities, losses, damages, judgments, settlements, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use or misuse of the CashNow platform or services.
• Your violation of these Terms & Conditions.
• Any inaccurate, false, or misleading information provided by you.
• Your infringement of any third-party rights, including intellectual property or privacy rights.
• The sale or attempted sale of stolen, counterfeit, blacklisted, or unauthorized devices.
• Your violation of any applicable law, regulation, or government order.
• Any fraudulent, negligent, or unlawful act committed by you while using our services.

CashNow reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in the defense of such claims.

13. Termination

CashNow reserves the right to suspend, restrict, or terminate your access to the platform or any of its services at any time, with or without prior notice, if we reasonably believe that you have violated these Terms & Conditions, applicable laws, or engaged in fraudulent, abusive, or unlawful activities.

We may also suspend or terminate services for operational, technical, security, or legal reasons where necessary to protect CashNow, its users, partners, employees, or business interests.

Grounds for Termination

• Providing false or misleading information.
• Violation of these Terms & Conditions.
• Fraudulent or illegal transactions.
• Attempting to manipulate device pricing or inspections.
• Selling stolen, counterfeit, or blacklisted devices.
• Unauthorized access to the platform or other user accounts.
• Misuse of OTP verification, payment systems, or partner services.
• Activities that may harm CashNow's reputation, operations, or users.

Upon termination, your right to access or use CashNow's services will cease immediately. Any provisions of these Terms that by their nature should survive termination, including indemnification, limitation of liability, intellectual property rights, governing law, and dispute resolution, shall continue to remain in effect.

14. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. By using CashNow, you agree that your use of the platform shall be subject to the applicable laws, regulations, and statutory requirements of India.

Any dispute, controversy, claim, or legal proceeding arising out of or in connection with these Terms, your use of the CashNow platform, or any transaction conducted through our services shall first be attempted to be resolved amicably through mutual discussions between the parties.

If a dispute cannot be resolved through mutual discussions within a reasonable period, it shall be submitted to the competent courts having jurisdiction in Maharashtra, India, which shall have exclusive jurisdiction over such matters, unless otherwise required by applicable law.

Compliance with Applicable Laws

• Information Technology Act, 2000 and applicable rules.
• Consumer protection laws applicable in India.
• Applicable taxation and financial regulations.
• Data protection and privacy laws as applicable.
• Any other statutory or regulatory requirements governing our services.

CashNow may integrate with or provide access to third-party services, websites, applications, payment providers, logistics partners, mapping services, communication providers, analytics platforms, or other external service providers to improve the functionality and efficiency of our platform.

These third-party services operate independently of CashNow and may be governed by their own terms, conditions, and privacy policies. We encourage users to review those policies before using such services.

Third-Party Services May Include

• Payment gateways and banking partners.
• Pickup, logistics, and delivery partners.
• OTP, SMS, email, and communication service providers.
• Maps, geolocation, and navigation services.

CashNow is not responsible for the content, availability, security, accuracy, or practices of third-party websites or services that are not owned or controlled by us. Accessing such services is entirely at your own discretion and risk.

CashNow reserves the right to update, modify, amend, or replace these Terms & Conditions at any time to reflect changes in our business operations, legal obligations, technology, services, or regulatory requirements.
